1. Acceptance of Terms

By accessing or using ADsHisaab ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and ADsHisaab ("we," "our," or "us"). By creating an account or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

ADsHisaab is an automated marketing reporting platform designed for digital marketing agencies in India. The Service provides:

• Integration with Google Ads, Meta Ads (Facebook/Instagram), and Google Analytics 4 (GA4).
• Automated data extraction from connected advertising platforms.
• Conversion discrepancy calculation across platforms, using GA4 as the benchmark.
• Automated PDF report generation with agency and brand branding.
• Scheduled email delivery of reports to configured recipients.
• Campaign performance analysis ranked by Cost Per Acquisition (CPA).

3. Account Registration

To use ADsHisaab, you must:

• Be at least 18 years of age.
• Provide accurate and complete registration information.
• Maintain the security of your password and account credentials.
• Promptly update your account information if it changes.
• Accept responsibility for all activities that occur under your account.

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at nandakumarvnadar@adshisaab.com if you suspect any unauthorized use of your account.

4. User Responsibilities

When using ADsHisaab, you agree to:

• Use the Service only for lawful purposes and in compliance with all applicable laws of India.
• Connect only advertising accounts that you own or have explicit authorization to access.
• Comply with the terms of service of Google, Meta, and any other platforms you connect.
• Not attempt to reverse-engineer, decompile, or extract source code from the Service.
• Not use the Service to store or transmit malicious code, viruses, or harmful content.
• Not attempt to gain unauthorized access to other users' accounts or data.
• Not resell, sublicense, or redistribute the Service without our written consent.
• Ensure that report recipients have consented to receiving emails from ADsHisaab.

We reserve the right to suspend or terminate your account if you violate these responsibilities.

5. Payment Terms

ADsHisaab is currently available free of charge during our beta period. During this period:

• All features are available at no cost.
• No credit card or payment information is required.
• We may introduce paid plans in the future with at least 30 days' advance notice.
• Existing users will be offered a transition period or discounted pricing when paid plans launch.

When paid plans are introduced, pricing will be displayed in Indian Rupees (₹) and will include all applicable taxes as per Indian tax laws.

6. Intellectual Property

6.1 Our Property

The ADsHisaab platform, including its design, code, features, documentation, and branding, is the intellectual property of ADsHisaab. You may not copy, modify, distribute, or create derivative works based on our platform without explicit written permission.

6.2 Your Data

You retain full ownership of all data you input into ADsHisaab, including brand information, report configurations, and recipient lists. We do not claim any ownership over your data.

6.3 Third-Party Data

Advertising data pulled from Google Ads, Meta Ads, and GA4 remains subject to the respective platform's terms of service. ADsHisaab acts as a data processor for this information and does not claim ownership over third-party platform data.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• ADsHisaab is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.
• We are not responsible for the accuracy of data provided by third-party platforms (Google, Meta, GA4).
• We are not liable for discrepancies between advertising platform numbers — we calculate and display discrepancies but do not control the underlying data.
• We are not responsible for changes to third-party APIs that may affect the Service's functionality.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
• Our total liability to you for any claims arising from the use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim (currently ₹0 during the beta period).

Nothing in these Terms shall limit our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded under Indian law.

8. Termination

8.1 Termination by You

You may terminate your account at any time by contacting us at nandakumarvnadar@adshisaab.com or by deleting your account through the platform settings. Upon termination, your data will be deleted within 30 days.

8.2 Termination by Us

We may suspend or terminate your access to the Service if:

• You violate these Terms or any applicable law.
• Your use of the Service poses a security risk to us or other users.
• We are required to do so by law or a court order.
• We discontinue the Service (with at least 60 days' notice).

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will survive.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India. You agree to submit to the personal jurisdiction of these courts for the purpose of litigating any such disputes.

Before initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at nandakumarvnadar@adshisaab.com. We will attempt to resolve the dispute within 30 days of receiving your notice.

10. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes:

• We will update the "Last updated" date at the top of this page.
• We will notify you via email at least 30 days before the changes take effect.
• We will display a notice within the ADsHisaab platform.

Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and terminate your account before the changes take effect.
